ENGAGEMENT• Artist strives to perform to the best of their ability in good faith and warrants work is 100% original according to Artist’s best knowledge.• Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.• Artist warrants that they will not copy or heavily reference unauthorised materials.• Artist reserves the right to refuse the purchase based on any reasons whatsoever.• Artist may change the adoptables prices in the future.• The Artist is not liable or responsible for consequences arising from Owners.• The Owner will receive an unwatermarked version of the adoptable.• If Owner fails to pay, delete claims, break the rules, falsely claim, spam or harass the Artist or others, they will be blacklisted, blocked and banner from purchasing from the Artist.• Reselling, Trading or re-adopting a purchased adoptable is allowed, but the Owner cannot sell it for more than what they paid for, unless accompanied by extra art equivalent to the price they purchased the artwork for.• Adoptables received through trades, gifts or freebies cannot be resold under any circumstances. Re-selling designs purchased from the Artist directly for profit is strictly prohibited.• The current Owner must make sure the new Owners are aware of the rules regarding the design and credits are carried over.2. CONTENT RESTRICTIONS• Artist can create content that is explicit, or NSFW (sexual or gore themed content), reserved for adults only.• Artist will not create content that is offensive, or inappropriate (hate speech, illegal content, ect...)3. DEADLINES AND DELIVERY• Immediate send after payment. The Artist will send the PNG file or picture(s), in any form of communication the Artist and Owners agree on.• Final deliverables are provided by the Artist via G-mail/E-mail by default or similar file transfer tools.4. REVISIONS• No revision allowed. Any revision can be made by the Owners, themselves.5. COMMUNICATION• Communication channels may include social platforms or via mail, according to Artist discretion.• Artist response time may vary due to the time zone.6. RIGHTS & USAGEArtist Rights :• The Artist retains copyright, redistribution and intellectual property rights to the original design, which includes but is not limited to display, advertising, work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.Owner Rights :• Owners receive exclusive, non-transferable usage rights to the work for personal use. Refer to commercial rights.• Personal use means: display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.• Owners must not claim the Artist's original designs and artwork as their own and must credit Artist using their social tag/username/link at the instance of display of the work or permanently on their websites, social media profiles, broadcast channels and so on.• Owner can edit or modify the Artist's original design after purchasing the adoptable.Commercial Rights :• Commercial usage rights are not included unless specified in the adoptable in question or listing on the Artist’s websites (i.e. vtuber models, stream overlays, emotes, and so forth) or as agreed upon.• Commercial rights means usage of Artist's work on streams or any monetized instances, or selling or reselling the Artist's work to another party, as a part of any product, or on another platform.• Usage of Artist's work for AI (artificial intelligence) tools; platforms or programs, ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.7. PAYMENTS & FEES• Payment must be sent within 24 hours after the Artist sends the proposal to the Owner. The Owner will receive the file(s)/picture(s) as soon as possible after the Artist receives the payment.• If payment is not sent within 24 hours, the claim will be directed to the previous highest bidder.• Once payments have been made, the Owner acknowledges the Artist's work and deliverables are digital and there are no physically shipped goods to receive.• Owner warrants they will not issue chargebacks and the refund policy mentioned below will be followed.8. CANCELLATION & REFUNDS• No refunds are allowed or will be made.9. CONFIDENTIALITY• The Artist and Owner acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information), or are incorporated into the deliverables, that will not be visible to the public shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.10. ACCEPTANCE• Only Owners that are 18+ are allowed to purchase NSFW content (sexual and gore themed content)• The Artist is not liable or responsible for possible consequences.• By proceeding to the purchase, you acknowledge that you have read and agree to the Artist's terms of service. ✧
